Dhaka: The High Court has stayed the Election Commission’s decision to cancel the nomination papers of two chairmen in the upazila elections for not resigning from the Union Parishad (UP).

As a result, there is no legal obstacle for these two chairmen to compete in the upazila elections without resigning from the post of UP chairman, the lawyer said.

Justice Sheikh Hasan Arif and Justice Md. Bazlur Rahman’s High Court ordered with the bench rule.

Lawyers Shahdeen Malik and M Manjur Alam appeared for the writ petitioners in the court. Lawyer Touhidul Islam heard on behalf of the Election Commission. Assistant Attorney General MMG Sarwar appeared for the state.

The two chairmen are Mohammad Fakhrul Islam, the current chairman of Moglabazar Union Parishad of Dakshin Surma Upazila of Sylhet. He has been a candidate for the post of chairman in the Dakshin Surma Upazila Parishad elections.

The other is Chairman of Osmanpur Union Parishad of Khoksa Upazila of Kushtia. Ohidul Islam. He is a candidate for Khoksa Upazila Parishad election.

Lawyer Shahdeen Malik said that they submitted their nomination papers without resigning from the Union Parishad. The Election Commission’s Returning Officer and Appellate Authority have declared them ineligible for election. They filed a writ against it. Because UP chairmen are not bound to resign. The court ordered that they can contest the upcoming upazila elections from the post of UP chairman. Their nominations were declared valid by the High Court. Now this lawyer thinks that it should be applicable to everyone.

Upazila Parishad elections will be held on May 8 in those two upazilas.
