The second application was sent by another organization called ‘Constitution Bachao Nagrik Abhiyan’. 17 thousand 400 people have signed it. It has been said in that petition that the Prime Minister has violated the Representation of the People Act, 1951 along with the violation of the Model Election Code of Conduct. Because, through that comment, the Prime Minister not only incited communalism, but also increased the hatred of Hindus against Muslims.

The signatories of this organization also said that Modi has not only told blatant lies about the Congress party, its manifesto and the former prime minister, but has also called Muslims infiltrators. Disrespected by producing heaps of children. In the petition, they said that Modi should be reprimanded now. Let a ban be imposed on his preaching, which has committed such offences.

But the commission is strangely silent and unresponsive. Even after 48 hours have passed after such a serious comment, they have not even commented, let alone taking action. The second phase of the election is next Friday.

In an affidavit in a Supreme Court case in 2022, the EC said it had no power to ban any political party or its leaders as there was no specific law banning hate speech. However, according to the Representation of People Act, they take some measures in such cases.

The case was filed by lawyer Ashwini Upadhyay. In the petition, he said that the central government should implement the recommendations of the Law Commission report on hate speech.
