Chittagong: Potiyar Abul Bashar Chowdhury died about 9 years ago. But it was not informed to the court.

As a result, 9 months after his death, the court sentenced Abul Bashar, who died in a corruption case, to 7 and a half years of imprisonment, and 1 year and 1 month of rigorous imprisonment without paying a fine of Tk 10,000,000.

Last Sunday (September 18) Chittagong Divisional Special Judge Munshi Abdul Majid’s court gave this verdict. Even though he died 9 months ago, the incident happened because the court was not informed about the matter.

Abul Bashar Chowdhury, son of late Abdur Rashid Chowdhury of Ward No. 9 Govinder Khil area of ​​Patia Municipality. He was the former Security Inspector of Chittagong Port Authority.

To find out about the death of Abul Bashar, BanglaNews contacted Sheikh Saiful Islam, Councilor of Ward No. 9 of Patia Municipality. He said the death was true.

Sheikh Saiful Islam told Banglanews that former Chittagong Port official Abul Bashar Chowdhury has passed away. He was the advisor of Awami League in Patia town. He was buried at Hadu Chowdhury Jame Masjid graveyard.

Maulana Jamal Muezzin of Hadu Chowdhury Jame Masjid No. 9 of Patia Municipal Council told Banglanews that Abul Bashar Chowdhury passed away on December 23, 2021. He was buried in our mosque graveyard. I attended the funeral. The grave also has plaques with his date of birth and death.

According to court sources, on September 9, 2008, Abul Bashar Chowdhury submitted the statement of assets to DU. In his submitted asset statement, he declared the acquisition of immovable assets of Tk 27 lakh 17 thousand 421 and immovable assets of Tk 21 lakh 47 thousand 141. After verifying the assets statement given by him, the investigating officer of the ACC found the information of acquisition of immovable assets of Tk 41 lakh 59 thousand 453 and immovable assets of Tk 21 lakh 47 thousand 141.

It can be seen that he has concealed the information of acquisition of immovable assets of Tk 14 lakh 42 thousand 32. He also acquired known non-income assets of Tk 55 lakh 10 thousand 126. On February 11, 2015, Chittagong ACC Integrated District Office-1 filed a case against Abul Bashar Chowdhury at the city’s Doublemooring police station. On August 30, 2016, the investigating officer, the then assistant director of the ACC, MH Rahmatullah submitted the charge sheet to the court. The complaint was filed on April 6, 2017. Out of total 13 witnesses in the case, the court accepted 8 witnesses. Abul Bashar Chowdhury was last present in the court on December 12, 2021.

ACC PP Kazi Chanwar Ahmed Lovelu told Banglanews that Abul Bashar Chowdhury used to attend court regularly in the ACC case. In the end he did not appear in the case. His lawyer and family did not inform the court about his death.

He also said that the court sentenced Abul Bashar Chowdhury to 6 months of rigorous imprisonment under section 26 (2) of the Prevention of Corruption Act 2004, and another 1 month of rigorous imprisonment in default of payment of a fine of 20 thousand taka, as he was found guilty of concealing information of Tk 14 lakh 42 thousand 32 in the ACC report. In addition, the court sentenced him to 7 years of rigorous imprisonment under Section 27 (1) of 2004, and sentenced him to 1 year of rigorous imprisonment for non-payment of a fine of 10 lakhs of taka.

Abul Bashar Chowdhury’s lawyer Ratan Chakraborty told BanglaNews that Abul Bashar Chowdhury was ill. Last appeared in court in December 2021. At that time, I brought the fact that Abul Bashar Chowdhury was sick to the attention of the court. I prayed to the court to finish the case quickly.

He also said that Abul Bashar Chowdhury’s mobile number was contacted several times. In the case of not being able to connect, a time application was filed in the court last January. Whether he is alive or dead we have no information. If the family had informed me about the death, I would have informed the court.

Later in the case, Abul Bashar Chowdhury’s lawyer applied for time several times. The last arrest warrant was issued against Abul Bashar Chowdhury on May 16. It has been sent to Patia police station.

He also said that the court is not yet officially aware of the death of Abul Bashar Chowdhury. If Abul Bashar Chowdhury had informed the court about the death, then the proceedings of the case would have been stopped immediately. After the verdict, Abul Bashar Chowdhury, a resident of Patia informed me about the death.
