For disobeying the order of the court, summons have been issued against Chittagong Development Authority (CDA) Chairman Zahirul Alam Dubash Prakash Dolphin, Secretary Anwar Pasha and 5 people.
On Thursday, the first labor court of Chittagong Mohammad Taufiq Aziz gave this order, said Ali Newaz Khan, the bench assistant of the court.
The remaining three accused are CDA Deputy Secretary (Acting Secretary) Amal Guha, CDA Chief Engineer Kazi Hasan Bin Shams and CDA Finance and Accounting Officer Mohammad Najer.
Sukhmoy Chakraborty, lawyer for the accused, said that the court took cognizance of the case and issued summons against the accused. They have been asked to appear in court by September 25.
According to court sources, on March 13, 2014, due to the activities of a legitimate trade union, CDA dismissed Habibur Rahman (termination), a senior assistant and General Secretary of Chittagong Development Authority Employees League. At that time he was working as a senior assistant. He filed a case in the First Labor Court of Chittagong on June 1 of that year to get the victim’s job back. whose case number is 09/2014.
On July 24 this year, the court canceled the removal (termination) order and ruled. Ordered reinstatement of Habibur Rahman in his job with full salary and dues within 30 days of pronouncement of the judgment. Four days after the verdict, on July 28, Habibur Rahman personally went to the CDA and submitted the letter of joining the service after collecting the copy of the verdict. On the same date the joining letter is duly registered and sent by post.
Last August 3 last sent humanitarian application for rejoining by post. However, the defendants in the case, in connivance with each other, deliberately did not reinstate the job, showing direct contempt of the court’s judgment. Jatiya Sramik League President Noor Qutb Alam Mannan (CDA) sent a written recommendation letter to the Chairman giving specific opinion on joining the job of victim Habibur Rahman.
According to the court sources, it is mentioned that even in 30 working days, the 5 defendants in connivance with each other did not join Habibur Rahman, did not pay the arrears of salary, allowances, resorted to lies and trickery. Habibur Rahman filed a case on August 31 according to Sections 283, 292, 293, 303 and 307 of the Labor Act 2006 for deliberately and habitually violating and disobeying the law and the court’s rulings, orders, decisions. The court accepted the case.
