The highest court of the country has canceled the decision given by the administrative appeal tribunal to reinstate 85 sacked upazila election officials.

The six-judge Appellate Division headed by Chief Justice Hasan Faiz Siddiqui on Thursday accepted the appeal filed by the state against the verdict given by the Administrative Appellate Tribunal almost a century ago.

Attorney General AM Amin Uddin, Additional Attorney General Sheikh Mohammad Morshed and Mohammad Mehedi Hasan Chowdhury heard the state’s side in the court. On the other hand, senior lawyers AF Hasan Arif, Prabir Nyoggi, Salah Uddin Dolan and Kamrul Haque Siddiqui heard on behalf of the sacked election officials.


Before this, on September 3, 2005, 327 people were temporarily selected as upazila election officers through the Public Works Commission (PSC).

Then in 2007 during the caretaker government, 327 people were evaluated. From where 85 people were fired. On March 23, 2009, the dismissed candidates filed a case against this decision, and the Administrative Tribunal dismissed it. Allowing the appeal against this judgment, the Administrative Appellate Tribunal ruled in favor of reinstatement of 85 officials.

Against that verdict, the state filed four separate leave-to-appeals. Subsequently, the Appellate Division Chamber Court on 29 April 2010 stayed the operation of the judgment of the Appellate Tribunal and referred the matter to the regular bench of the Appellate Division for hearing. The state party filed a separate appeal in 2011. After the hearing of those appeals, the highest court of the country gave its verdict.
