The Appellate Division has stayed the High Court’s judgment declaring null and void Section 41 (1) of the Public Service Act regarding taking prior permission of authorities to arrest government employees. At the same time, the application hearing has been adjourned till October 23.

The Appellate Division headed by Chief Justice Hasan Faiz Siddiqui gave this order on Thursday (September 1).

Lawyer Manzil Morsed was in favor of the writ in the court today. On the other hand, Attorney General AM Amin Uddin was for the state.

Earlier, Appellate Division Chamber Justice M Inayetur Rahim on Wednesday (August 31) fixed the date for the hearing without granting a stay on the plea of ​​the state.

The appeal was against the judgment of the High Court striking down the provision of obtaining the permission of the Government or the appointing authority to arrest the Government servants for criminal offences.

On August 25, the High Court canceled the provision of taking the government’s prior permission to arrest government officials and employees in criminal cases. The court said that as per Section 41(1) of the ‘Government Employment Act, 2018’, the provision of prior consent to the arrest of government employees is illegal, unconstitutional and violative of fundamental rights. Justice Md. Mojibur Rahman Mia and Justice Kazi Md. A High Court bench consisting of Izarul Haque Akand passed the verdict.
