After nearly three years of legal battle, a mother got her child back from her ex-husband on the order of the Appellate Division.

However, the Appellate Division of the Supreme Court ordered that the mother of the child, Sadika Sheikh, cannot leave the country with the child without the permission of the concerned family court.

A four-member appellate bench led by Chief Justice Obaidul Hasan passed the order after hearing Sanyur’s bail application in the contempt of court case on Monday.

During the hearing, Sadika’s lawyer Fawzia Karim Feroze told the Appellate Division that Sanyur’s family members handed over the child to Sadika following earlier instructions.

Lawyer Munsi Moniruzzaman heard on behalf of Saniur Rahman in the court.

Bangladeshi citizen Sanyur and Indian citizen Sadika got married in 2017. They lived in Dhaka.

At one point they got into a conflict over various issues.

Meanwhile, Sadika applied to the High Court to take custody of the child.

Following the legal battle, the High Court directed Saniur Rahman to hand over the child to her mother Sadika by November 16, 2021. But that order was not obeyed.

On November 17, 2021, the High Court ordered Saniur Rahman and the police authorities to produce the child in court on November 21. Sanyur was also ordered not to leave the country.

Dhaka Metropolitan Police Deputy Attorney General Vipul Bagmar told the High Court that Sanyur left the country with the child on November 16.

Earlier on November 17, 2021, the High Court issued a contempt of court ruling against Saniur Rahman for leaving the country with his three-year-old son.

The High Court sentenced Saniur Rahman to six months imprisonment on December 15, 2021 for contempt of court.

Saniur Rahman surrendered to the lower court on October 23 this year in the case of contempt of court. The lower court ordered him to be sent to prison.
